Terms of Service

2.1 Scope of Services

Labmarketdev provides enterprise-grade web development, marketing technology integration, data-tracking infrastructure deployment, and related digital services as described in individual project proposals and service agreements. Each engagement is governed by a specific project scope document signed by both parties.

Services include but are not limited to: web architecture design, full-stack development, MarTech stack integration, API development, cloud infrastructure setup, and system monitoring.

2.2 Payment Terms

All services are billed according to the pricing structure specified in the applicable project proposal. Standard payment terms: 50% deposit upon project initiation, 25% at midpoint milestone, and 25% upon final delivery and acceptance. Payments are due within fourteen (14) days of invoice date.

Late payments incur a 1.5% monthly interest charge. Services may be suspended if payment is overdue by more than thirty (30) days.

2.3 Intellectual Property

Upon full payment, all deliverables, custom code, designs, and project assets are transferred to the client. Labmarketdev retains the right to display anonymized case studies and portfolio entries unless explicitly restricted in the project agreement. Third-party libraries and frameworks remain subject to their original licenses.

2.4 Project Timeline

Timelines are estimated in good faith based on project scope at initiation. Delays caused by client-side factors (late content delivery, feedback delays, scope changes) will extend the timeline proportionally. Scope changes after project initiation may require a revised proposal and timeline adjustment.

2.5 Limitation of Liability

Labmarketdev's total liability under any engagement shall not exceed the total fees paid for the specific project giving rise to the claim. We are not liable for indirect, consequential, or incidental damages, including loss of profits, data, or business opportunities.

2.6 Termination

Either party may terminate a project agreement with thirty (30) days written notice. Upon termination, the client shall pay for all work completed to date. Work product delivered prior to termination remains the property of the client upon payment.

Refund & Reimbursement

Labmarketdev operates on a milestone-based payment structure. Refund eligibility is assessed based on the project stage at the time of cancellation request. Deposits are non-refundable once project work has commenced. Milestone payments for completed and accepted work phases are non-refundable.

4.2 Cancellation Process

Cancellation requests must be submitted in writing to [email protected]. Upon cancellation, an itemized invoice will be issued for all work completed, services rendered, and third-party costs incurred. Any prepaid amount exceeding the invoiced total will be refunded within thirty (30) days of cancellation confirmation.

4.3 Dispute Resolution

In the event of a dispute regarding refund eligibility, both parties agree to engage in good-faith negotiation for a period of thirty (30) days before pursuing alternative resolution methods. Disputes not resolved through negotiation will be submitted to the competent courts of Meaux, France, in accordance with applicable French law.

4.4 Non-Refundable Items

The following are non-refundable: domain registration fees, third-party licensing costs, completed and approved deliverables, consulting hours already rendered, and infrastructure setup costs (server provisioning, SSL certificates, CDN configuration). These costs are passed through at cost without markup.

4.5 Quality Assurance

All deliverables are subject to a quality assurance period following delivery. Defects identified within the QA period will be corrected at no additional cost. Post-QA modifications, feature additions, or scope expansions are billed according to the current service rate card.

4.6 Force Majeure

Labmarketdev shall not be liable for delays or failures in performance resulting from circumstances beyond reasonable control, including but not limited to: natural disasters, pandemics, government actions, internet infrastructure failures, or third-party service outages. In such events, timelines will be adjusted and refunds assessed on a case-by-case basis.
